UK court orders payment of Samsung’s legal fees
Apple vs. Samsung wars don’t seem to end soon. We all know that Apple had accused the South Korean company for ‘infringing’ the iPad’s design, but these allegations were not accepted by the court. Hence Apple had to place an official “apology” on the homepage of their website, stating clearly that the contested design was not in any way stolen by Samsung. But Apple played “absent minded” and did not comply exactly with the court’s ruling. When the post did appear, it came in the form of a link to a statement which however Apple had modified and had also added content to.
Well, Themis may be blindfold, but she sees everything! The Court of Appeal of England and Wales found the posting on Apple’s website to contain inaccuracies and “false innuendo”. Moreover, the added content, according to Judge Birss, was “taken out of context” and hence, false and “undermining the intent” of the order. As a result, on Friday the UK court issued a ruling whereby Apple was ordered to pay Samsung’s legal fees on an “indemnity basis,” which is higher the “standard” basis. Not to mention that earlier this month Apple was ordered to rewrite the notice as per the intended order.
